Does my Ex have a case?

I am looking for information. I have an almost 11 year old son from a previous relationship. My ex had been paying me £100 a month in child support for the past 3 years. Before that nothing. Recently my son has been complaining of my ex calling him stupid and stating that he was embarrassed to be seen with him. Ive had experience with how mentally abusive my ex can be as that is why we are not together. And yesterday, after an argument the both of us had over child support where he then asked if he needed to continue paying it, he told me son to choose which parent to live with. My son is incredibly upset over this and doesn't want to return to his father's house. He usually stays there once a week. I have told my ex that he won't be taking our son overnight for now but he is welcome to visit him. He wants to take us to court for custody. Does he have a case here? I realise that since he has parental rights i cannot stop him seeing him, and I don't want to, but I don't want my son to be emotionally abused by him any more. I am enraged that he out the pressure of "choosing" on our son. I've had harassment and hassle from him for 11 years and it angers me, but he's gone too far this time!

It is very unlikely he would get an order stipulating that your son lives with him, especially if your son doesn't want to live with him. If he does take this to court the judge will decide what is in your son's best interests and will take into account your son's wishes and feelings. The court will not change a settled living arrangement unless there is a very good reason. Your ex not wanting to pay child maintenance is not a good reason.
