My daughters father has been emotionally abusive towards me and on one of his contact days he asked me about a mark on my daughters leg, I asked him to send me pictures and said I would call the police if he didn't because we had a court case prior to this because my son had said my daughters dad had hurt him and he had a bruise on his arm but there was not enough evidence so after 3 months contact centre he was allowed to see our daughter twice a month. Because of this I always take photos of my daughters arms, leg and ect before her dad picks her up this was also advised to do by a previous social worker. The photos on this contact showed no marks at all.
He sent me two pictures of this mark on my 2 year old daughters leg and it was such a horrible nasty bruise and clearly not one from falling over, for that to of happened in an hour of him having her I was so shocked and called the police to do a welfare check, unfortunately the police didn't manage to do it before he brought her back home, once she was back home there was no bruise, it had just gone and he wanted me to apologise to him, he tried telling me it was probably a juice stain which it clearly wasn't. The police came to check on her once she was with me and after seeing the pictures of this apparent bruise and seeing nothing on her anymore they reported it as a verbal domestic incident as he appears to of done to cause me distress. They advised me to get a non molestation order and sort contact out at court again. He's contested the non mol so the court hearing isn't for a while yet, I was hoping as soon as I had that contact could still happen as he wouldn't be allowed to use her to get to me, he also refused to do an undertaking, because of the waiting I decided to apply to court and had to make the decision to break the contact order until the case was heard and offered to use the contact centre which his solicitors responded with a no.
Cafcass has done the report for the first hearing, on the phone he actually believed my daughters dad saying it was a juice stain and it was a minundertanding I had until I asked for his email to send the pictures, the cafcass worker rang me back and said it looked real and asked me if it was definitely her in the photo to which it was and said he hadn't come across this before.
I have received the cafcass report and has advised on my daughters dad having supervised contact for the time being. Her dad has also said I display sociopathic tendencies which I find is ridiculous considering I have Asperger's syndrome.
He's also brought up me self harming when I was much younger but never mentioned this in the previous court case and was way before I was a parent.
I've also found messages of him referring to himself as a jelous sociopath so I'm unsure as to why he's calling me one!
The cafcass worker hasn't mentioned in the report that my daughters dad had said it was a juice stain, instead my daughters said is now saying that I'm the one who fabricated it and not him.
He's said in his statement for the non mol that he wasn't accusing me or blaming me, saying it was a juice stain now all of a sudden has changed his mind to the cafcass worker, he also mentioned in his statement that he noticed the bruise when he got her out the car seat at the shop but where the bruise was you would of been able to see it clearly whilst putting her in the car seat from my house.
The cafcass worker has recommended the courts to appoint a guardian 16.4
What does it mean exactly?Is it bad?
I've shown the photos i took before contact to the cafcass worker showing no marks on her but he never mentioned this or mentioned the police report in his report for the courts, this all happened in his care on that day so I'm confused as to why the want to do the 16.4 can anyone help?
