Fell off water slide on holiday?

cheekymonk · 11/08/2017 19:05

Hi there. Have just returned from holiday on the Canaries and whilst there visited the obligatory water park. I had been on several slide whilst there, not consumed any alcohol
And had taken regular breaks and had top on to avoid sunburn. Whilst I was riding on a four ring ride with my DH, DS and DD I fell out of my tyre and hurtled out of the slide at speed, banging my head, losing a fair bite of blood and suffering amnesia. The lifeguards were attentive and I was cared for until an ambulance arrived. I was then taken to hospital and had an overnight stay. I was given 6 stitches and on an IV drop as
Not allowed food or food drink due to possible scan the following day(not done). I had an X-ray and was then certified fit to fly by Dr. I had travel insurance and paid the excess.
My query is whether the park was negligent? The attendants kept us waiting at top of slide for approx 10 mins. I am very obese and I think they were unsure about allowing me to ride. However I had been on an identical ride previously and been ok and the wait made me more anxious and weaker as they kept telling me off and to hold on tighter and keep my back straight. I struggled to do this for the time they kept us waiting which was much longer than others.
My head is painful and I feel the holiday was ruined by the experience. Not sure what to do? Any suggestions?

How do you know it wasn't an accident @GreenTulips?

youarenotkiddingme · 11/08/2017 21:38

Medical care in Tenerife is not the same as it is in the U.K. Here it's get you out asap! There it's like the old 1950's style medical care we had. You stay in and recuperate and they tell you very little!

When I had ds in that hospital my partner couldn't even come into the labour suite!

LockedOutOfMN · 11/08/2017 21:38

Hi OP, sorry, I have no legal, etc. advice to offer, but I'm so sorry that happened to you and I hope you recover speedily from your injuries. I also hope you enjoyed the rest of your holiday.

SmokingGun · 11/08/2017 21:38

A few years ago I went on a very similar ride in Dom Rep, despite knowing I have an issue that means my knee cap regularly dislocates. I hit the water at the bottom with such force that lo behold my knee cap popped out.

I didn't even think about claiming anything as I knew there was a risk of injury with such rides and my risk was much higher than others. I accepted my own stupidity in doing something that with the benifit of hindsight I shouldn't have done and I now am much more careful with what rides I choose to go on, especially at Water parks.

I think you just have to put this down to an unfortunate accident and take some personal responsibility for pursuing with the ride even though you yourself admit you felt anxious and uncomfortable.

I do quite understand your point about not being able to hold on though. Is this because the ride was going so fast that you lost your grip?

Nicknacky · 11/08/2017 21:39

So did you fall out or just bang your head against the slide?

I meant i don't understand not do!

GreenTulips · 11/08/2017 21:40

How do I know it wasn't?

That's down to the insurer to investigate

HotelEuphoria · 11/08/2017 21:41

this isn't really about safety procedures though is it? It's about how much you think you can get out of it. Pay for next year's holiday.

SSYMONDS · 11/08/2017 21:42

I think you're being weirdly bullied on this thread OP and I think what happened to you is awful.

If the OP had had an accident because she was too thin for the ride would you all be so mean?

If the park have a ride for the public, it is their responsibility to make it safe, including weight restrictions and protocols. You should be able to get on a ride assuming you won't need 7 stitches and a night in hospital.

I hope you feel better soon OP, I'm sorry this happened to you.

Bluntness100 · 11/08/2017 21:42

Op, what do you want, they weigh everyone before they get in? It's not enough to state a weight limit and expect people adhere to it? People can break it and rhe staff are still at fault?

You all knew you were over weight. Did you tell the staff this? I'm guessing not. So you wanted them to look at you all and guess? You broke the rules but wanted them to look at you and just know you were?

I'm sorry but I also think you shouldn't be trying to make money from this. You knew. You did it anyway and you took advantage of the fact they weren't sure to allow you to knowingly break the rules.

Next time you see a weight limit, as harsh as it sounds, adhere to it. Just like when we have kids and we don't try to get them on when they are below min height then blame the staff for not knowing they were wearing wedges and were smaller.

cheekymonk · 11/08/2017 21:43

Fell out and banged head. The float was high up at time. I couldn't hold on against gravity and speed of water.

If the OP had had an accident because she was too thin for the ride would you all be so mean?

My replies have absolutely nothing to do with OPs weight, especially as I'm not slim myself.

Oblomov17 · 11/08/2017 21:44

Kinaree is not Amber. It's red. I think.

Second, it's quite tame. Or so I thought. Compared to splashdown, in Dorset, and others.

You spin up to the green high bit, mid ride.

Then you go down the tube to the bottom splash pool. Where you get out of your s
Float. And climb the steps to exit the ride.

Is this where you fell off OP.

In the splash pool? At the end of the ride?

You stated that you fell out and bumped? On what?

Bluntness100 · 11/08/2017 21:44

If the OP had had an accident because she was too thin for the ride would you all be so mean?

It's not mean, If rhe sign said you had to be above a certain weight to ride and you knowlingly did it any way then yes the responses would be the same, take personal responsibility for your decisions.

Oblomov17 · 11/08/2017 21:44

Banged head. At the top part? Ok.

Mychildcouldnotbreaatfeed · 11/08/2017 21:45

Fell out? So you came out over the side of the ride? And landed on hard ground? Didn't exit the ride by the water ?

Nicknacky · 11/08/2017 21:45

I cant see how you can prove they have been negligent, its just one of those things that happen.

nocoolnamesleft · 11/08/2017 21:46

If you literally came flying out of the slide, off it completely, hitting the ground, then yes, it really does sound like they're at fault. If you came off the ring, but stayed on the slide, bumping your head on the side, then I doubt you'll get anywhere.

It may, or may not, be that the delay before setting out impacted upon the likelihood of the accident. However, unless you actually told them that your arms were getting tired, before even starting the ride, so you would be less able to hang on, I don't think you could reasonably expect them to know that. Because most people probably could hang on more easily. (I am obese, I'm not trying to have a go)

sororitynoise · 11/08/2017 21:47

Get a bloody grip

Oblomov17 · 11/08/2017 21:49

Kinaree

SmokingGun · 11/08/2017 21:50

Did your DH and DS also loose grip too? If it was just you then I think you would have a hard time proving you didn't just let go.

Oblomov17 · 11/08/2017 21:50

Sorry. That link doesn't work.

HensAndRabbits · 11/08/2017 21:51

bluntness there is no weight limit. Op stated that she is overweight, the lifeguards seemed unsure whether to let her ride due to this (but op isn't sure exactly what was said) and is wondering if them still letting her go ahead and ride was negligent on their part.

She didn't see a weight limit, ignore it and go on anyway.

Mychildcouldnotbreaatfeed · 11/08/2017 21:51

She knew she was tired and weak and scared.
