Can I do anything if I lost a medical negligence claim because a medical expert's opinion was not impartial? My lawyer was diplomatic but said she was surprised by the report he submitted. The insurance company was unwilling to continue to back my claim after several years because the law firm put the chance of winning the case at 51% in my favour and they required something like a 60% chance of winning. I couldn't afford to pursue the claim without legal aid which I originally had. Is there any avenue I can pursue to get the medical expert to explain his reasoning fully. I have written to him but his reply was ambiguous and vague. I would prefer not to go through the medical ombudsman.
