Question re employment law

Person at work is 70+ and has to sign a form each year to state they want\are able to work another year. Person has been employed 20+ years.

My questions are

1. As they have to sign the OK every year are they now on a yearly contract or is this an extension to their original contract?
2. if it is yearly contract can work decide not to let them renew as the year is up?
