Terraced fence

I'm having our garden redone but our neighbour hasn't replaced our shared fence which deeds show she is responsible for, even though she has just replaced her fence on the other side at the end of the terrace.

Is there anything we can do to get her to replace it? It is not in a good condition so I don't want to spend £££ on landscaping our garden for it to spoilt by a shabby fence on one side.

We have replaced the fencing we are responsible for on the other side.

We are on good terms and would like to keep it that way.

Unless she is the first owner of the property (ie she bought it from the builder) any obligation the deeds place on her to replace the fence will not be enforceable against her, as she was not a party to the deed that creased the obligation. Same will apply to you and your other fence.

I suggest you simply choose your own fence and erect it up against, but not on, the boundary. Keep photographic evidence of the existing boundary, evidence of where the new fence is in relation to the old, and you should be able to prove in the future that the fence is yours and it sits on your land.
