Parking notice..

I'm not sure if this is in the right place but here goes..

I parked in asda car park today and was in such a rush with dd that i completely forgot to pay for the parking. I came out to find a parking notice stuck to the window, i was parked in a parent and child bay (dd is 2)
The fine is £40 if paid within 14 days then increases to £70 if paid after the 14 days. Dp tells me i don't need to pay it as it isn't police/council issued. Is this true? Can they take me to court if i ignore it?

I would just pop into Asda (preferably on foot, WTF should you pay to park to ask them to cancel this ticket?) and it should all go away.

Our local asda is free between the hours of 4pm and 8am tribpot might have to do late night shopping from now on (which i prefer) i called customer services back whilst i was sat in the car park and they told me to go back and quote the reference i was given and tell them to cancel it but they won't, i might give it another go tomorrow before wednesday.

From a legal viewpoint they cannot claim back more than they have lost in revenue (£1??) and they are not the council or police. Just don't acknowledge the ticket - they will not take you to court for £1 which is all they claim.

I think i will be ignoring it but i will speak to the cab first to seek some upto date advice a lot of it online seems to be based in england and wales there isn't much information for scotland.

  • Parking on private land

A private car parking ticket is similar to a notice for breach of contract, as the owners of the car park are not allowed to fine or impose a financial penalty in the same way as the police and local authorities.

At the entrance to all privately-owned car parks there should be a notice clearly stating the terms of use, and rules/regulations that motorists need to follow. This effectively forms a contract between driver and owner, and comes into play once you enter the car park.*

The sign at the entrance stated that you had to go into the car park to read the terms and conditions. So your effectively entering a contract without knowing what the small print says?

In Scotland here too. My dd got a ticket in the post recently for overstaying a 2 hour free parking from Highview Parking. We appealed to the store where she was shopping AND to the company (because appealing directly to the company stops the clock ticking on the 14 days reduced payment. It was cancelled, and we got 2 letters confirming that, presumably because we took 2 routes to cancel. We did have a legitimate reason for appealing, don't want to go into any detail here as we have been advised that companies regularly trawl websites including MSE for discussions. DD got a serious talking too as well!
