Parking notice..

I'm not sure if this is in the right place but here goes..

I parked in asda car park today and was in such a rush with dd that i completely forgot to pay for the parking. I came out to find a parking notice stuck to the window, i was parked in a parent and child bay (dd is 2)
The fine is £40 if paid within 14 days then increases to £70 if paid after the 14 days. Dp tells me i don't need to pay it as it isn't police/council issued. Is this true? Can they take me to court if i ignore it?

I am just back from my look around the car park. The 1st signs state that the car park is payable by tarriff only at the available pay machines but to read the terms and conditions you have to enter the car park. I had a look around the car park itself and there is between 10-15 machines (car park is massive approx. 700 spaces) and about 8 machines. They are only noticeable if you have a look out for them. I will email asda's head office if that fails, then i will appeal to PE. I didn't notice any ANPR cameras.

Tricky - your grounds for appeal are that you were not issued with a Notice To Keeper within 15 days of the alleged offence. Debt company letters do not count.

Avoid giving your name as the driver. Refer to the driver in the third person.

I last had one two years ago and law in Scotland was very different from England.

I read Mse regarding scotland law and wrote a letter saying I wasnt driving and was not obliged to tell them who was and not to contact me again (template in mse). Never heard from them again.

Might have changed since then.

OP, do check this with CAB when they reopen, but as you are in Scotland the law is different, and Beavis does not apply.

ParkingEye do have the right to ask for your details from the DVLA, but so does anyone else who can show a "reasonable need to know" and can pay the small fee involved. You're right that they mention it to intimidate.

In Scotland, they are obliged to prove who was actually driving the car. They can contact you as registered keeper, but you are under no obligation to admit you were driving, or to grass up someone else. If they have cameras which not only record your license plate but also produce a clear photo of the driver, you're buggered. But that's unlikely.

I'd hold off on contacting the supermarket or anyone else till you've checked this with CAB. There's a risk you'd be admitting liability.

Well i contacted asda headoffice and they told me to take the notice and reciept to my local asda store (customer services) and they will cancel it for me but i was to take my dd with me to prove that i do actually have a child

I won't mention anything about me being the driver. I will just say the driver found this on the window after doing a shop with my dd.

Just say you are the registered keeper

Don't even mention the driver or how or where they found the parking charge.

Just refer to the parking charge

Trick s you need to have appealed to the parking company first ( they decline the appeal) and give you a POPLA code.
Once you have POPLA code then you can appeal online or in writing.

Tricks you need to

Appeal to the parking firm and say no notice to keeper was sent

They should either send you POPLA code or accept your appeal. If they don't do either then complain.

You can then threaten to go to court and sort out the case in court as they didn't send you the correct paperwork.

Don't let them bully you, they would have to prove in court that they followed all the correct procedures. That's why applying to DVLA for doing about what information they have given on what dates is important because most of these firms don't follow the rules. Once you are armed with this, they know that if they show up in court you have the means of winning.

I don't know the lady on the phone thought i might've recieved the ticket because i parked in the parent and child bay Confused they haven't managed to cancel it since another company took over the car park and told them not to do it anymore. Which i don't really understand because the head office was certain that they would. So i'm going to go to the cab when its open on wednesday and ask them for advice.
