I'm not sure if this is in the right place but here goes..

I parked in asda car park today and was in such a rush with dd that i completely forgot to pay for the parking. I came out to find a parking notice stuck to the window, i was parked in a parent and child bay (dd is 2)
The fine is £40 if paid within 14 days then increases to £70 if paid after the 14 days. Dp tells me i don't need to pay it as it isn't police/council issued. Is this true? Can they take me to court if i ignore it?

There are some very good websites dedicated to helping with appeals, but these are for England and Wales - not sure if different laws I. Scotland.

I. England and Wales you do not under any circumstances give them the details of who was driving.

They have 28 from the day after the ticket was issued to persue the registered owner.

If they don't get the time scales correct for protection of freedom of information PoFI then they can't collect and you can win your appeal

But if no ticket is issued they need to contact you within 14 days to be able to hold registered keeper responsible.

It's all about technicalities

Ignore Parking Eye, send asda the receipt and tell them what a loyal customer you are, and they'll cancel it.

I literally did it last week.

This is also the 1st time i have ever seen them enforce the fines. They have had pay machines for a long time now but this is the 1st time i have seen an attendant ticketing cars.

I would have to pull over in a yellow box junction or park in the car park, climb a 3 ft wall then cross the road (with hardly any crossing areas) to read the signs. There is 3 or 4 zebra crossings.

So op if I was in your shoes I would wait for 28 days

Then go to the DVLA website and put in a freedom of information request

The company can't apply for your details for 14 days after the ticket was issued on your windscreen.

If they do then they are breaking the rules of PoFI which also means you could if you choose counter sue.

With parking charges without windscreen the companies must apply for your details within 14 days and send the charge within 14 days to be valid( of course they can send the parking charge when ever they like, but it's just then it becomes easier for anyone to appeal and win)

Don't let them know you were driving the car, appeal without your address.
But sign your self the registered keeper and never admit to being the driver - talk about the driver in the third person

1.2 million parking charges were issued last year, 13000 were appealed

That's £60 a ticket on average

They prey on you being scared, they prey on the fact you will just pay up as it's easy, cheaper, less hassle

So do i appeal to asda or parkingeye themselves? I can appeal online or by post.

It is worth making an informal appeal to Asda but make sure you put in a formal appeal within the timeframe on the ticket.

I would appeal to asda first

And say they do have a contract with this parking company, say as asda employ this company and as asda is in charge of this company they can get the charge sorted if they choose.

They may try to dismiss it and say it's now in the hand of xyz but ultimately it is asda that can get it dropped, they employ this company.

If this doesn't work then send an appeal to the parking company - but expect this to fail. But this will get you a POPLA code which you need to appeal properly

I would start with Asda as PP have said. This has nothing to do with any form of 'appeal', but they are ParkingEye's customer so they have the ability to cancel the invoice to you if they wish.

You must expect your appeal to the parking company to fail and you must write as the registered keeper.

Don't rush though. As Eliza states stay with the time frame - but only by a couple of days. Keep screen shots if you appeal by email.

The reason you wait until the last minute is they need to be sending of for stuff etc and often are late which gives you more technicalities to not have to pay this invoice, and it is an invoice

Ring Asda customer services (head office) and ask for the parking department. Take an email address and email them with a photo of the receipt and any others you have.

Mine was for a different supermarket but they're all the same. They don't want to piss off genuine loyal customers.

Don't engage with PE at all.

Agree with others that you should contact Asda. I had the same issue with holiday inn and they cancelled the charge with parking eye.

ivykaty do you have any links re the timescales?
I have had two letters from debt recovery agencies after an alleged parking issue (never received a fine or notice on the car), the second letter threatening me with court, the fee having been bumped to £160 for non payment.
I have been advised to ignore it but wonder if its better to appeal.
I did look online but got a bit overwhelmed with all the conflicting info out there....

Holiday Inn is a place to avoid parking, they are renowned for parking issues.

Another tip is to photograph your ticket on the windscreen should you pay. Keep your parking tickets. Two tickets recently were for not paying, but tickets had been purchased, it makes it much easier if you have photographic evidence of this.

Tricky - assuming there was no ticket on the car the parking company need to have issued you with a Notice to Keeper within 15 days of the alleged offence.

Thanks Eliza I didnt hear anything for two months then got debt recovery letter, so am at a loss to know what to do next. Is it worth appealing or just ignore?
They do seem to prey on peoples fear....

Put in a freedom of information to DVLA

The parking company need to ask permission to forward your details on to a debt collection agency ( which the parking companies rarely do)

Keep the letters from debt collection agency

See from DVLA if permission was given, they will have applied for your details first then there should be a second request.

I wrote to debt collection agency and told them I gave them 14 days to take me to court or I may choose to take civil action for harassment.

Not heard any more for two months

Did you receive a notice to keeper from the parking company at all or just a letter from the debt collection agency?
