Hello, I am new to this so bare with me.
I am currently starting court proceedings with the ex as he has implied threats of taking my son from nursery and there would be nothing I could do about it and my worry is he wouldn't return him as a means to have a contact with me, after all he has only ever asked to have DS or get anything for him if I go with him, and I have no need to be part of it. has always refused mediation, and he hasn't seen his son in months. I have to have a meeting with Cafcass before the first hearing. He was emotionally abusive through the whole relationship, but I am lead to believe if I say anything against my ex it will go in his favour? So I am going to go in strictly factual and about my concerns. Understand I am not stopping contact, in fact trying to establish regular contact instead of him using our son as a weapon against me.
What I would like to know is, what happens if he does not respond to cafcass? He ignored the Mediator, every form of contact from the CMS, and I don't think he will respond to CAFCASS. Has anyone any experience of this? What will happen if he does not respond? Will it delay everything or will it go in my favour?
It's ridiculous I am the one paying for the child arrangements order as it is, as usually the other party takes it to court ..but he is not concerned about our sons welfare (I truely believe he is a sociopath) but only getting at me and being in control. And anything to protect my child from having a chance of being technically abuducted. And this isn't just me being a biased mother or trying to get my own back for the past .. I have an older daughter to another man and we have no problems sorting contact for our child and we aren't necessarily on the best of terms half the time ourselves.. but I always look out for the best interests of my children and although I don't believe my ex has much interest in his son, I want my son to know I have done everything I physically can regarding him and his father as he grows older.
