Any words of wisdom please ! I was injured in an accident a couple of years ago...insurance company not playing ball with the help I need to fully recover. The woman driving the car that hit me pleaded guilty to dangerous driving etc had points/Went to court.
So with insurance company not playing ball with the help I need....I just want an end to dealing with solicitors etc now but a further date has been set for next week for my compensation. Has anyone else been in this position? Does it normally goto court?

To be honest I'm sick of it all and just want it sorted.

Usually they will make an offer just before the hearing.

It is also quite usual for there to be 2 parts - admission of liability and then actual compensation. Have they already admitted liability and is it just ha hearing regarding the amount or are they actually disputing you were injured?

I had a psychological assessment a year or so ago, and there were some recommendationsort ref treatment including physio and cbt. I've had some treatment but it's not really been effective and I wanted to try to something else the therapist had suggested but the medical comany still haven't arranged it. it was June that they were meant to sort that type of treatment out. I'm presuming they are slow in sorting it?? I haven't heard they are disputing the effects of the accident-would I know that? Finding it quite stressful time be honest! I didn't even realise it was going to court again as i'm not familiar with these things.

If they have admitted they are responsible the hearing will just be about how much they have to pay you.

There will be some money for what you have actually spent (treatments etc) and some money for compensation (basically in layman's terms pain and suffering). There may also be a future loss of earnings claim too if the injuries prevent you working going forward.

These are sometimes settled prior to the hearing (sometimes even on the day) by them making an offer which you can decide to accept or not.

However, if they have not accepted they are at fault there will be a hearing to decide whether they are or not. If it is decided they are not to blame then there will not be any compensation paid. Even if they do no accept they are to blame sometimes they will make an offer because it is less hassle for them to make a smaller payment than going to court.
