Hi

Hoping someone can advise me.

I sent the divorce papers off to the court. With cheque etc. They have come back today and I'm just waiting for my soon to be ex husband to send his back.

So long as he send his back and agrees (should be no issue as we discussed what was being stated) do the courts then send me a letter to say when I can apply for a decree absolute?

I've looked online but I can't see a straight answer.

When your STBXH sends back the papers you can apply for decree nisi (I sent mine off in August and am still waiting to hear back!).

Once you've got your decree nisi you'll have to wait 6 weeks to apply for your decree absolut.

Right, thank you. He's sending them off this week. So really it's just dependant on when the courts get to it. Then apply for the decree nisi, then I take it they wrote back to you and give you a date you can apply for the absolute or can you apply literally 6 weeks from when you apply for the nisi?

No you have to wait until the date the nisi is declared in court and then wait another six weeks.

I'm still waiting to find out when my decree nisi will be declared.

Jane - divorce isn't ideal but sometimes there is no choice. I am getting divorced as my husband had an affair. What options do you think I should have considered before getting divorced? My children are fine. Things are different but it is better than living in a house where both parents are not happy. Ultimately we teach our children right and wrong and that even comes down to when it is time to call time on a marriage.

I don't think there is a straight answer! I was told in August 2015 that I should be divorced within 5-6 months but my decree nisi only came through on Jan 6 (not that my solicitor bothered to let me know at the time).

She then said this August that I should be divorced within 3-4 months but definitely by Christmas... this is a straightforward divorce - still relatively amicable with STBexH and the financial terms are agreed. I'm itching to ask when I will hear something but that will, of course, cost me money!

ps JaneNG - my husband left me because he "didn't want to do the family thing anymore" so yes, while I wasn't too keen on the idea of divorce I didn't feel I had any option but to take matters into my own hands!

depending on which court you have sent the papers to, there are delays in the system but it will happen!

Jane come on, what do you honestly think children prefer- divorced, happy parents with calm homes or miserable parents staying unhappily married in a tense, stressful home?

Er WHAT? You are not living her life. You have no idea why they are getting a divorce. Your comment is very outdated.
