Judicial Review Question

There is a slim possibility that I may be involved in a JR claim. My question is about where JR claims are published ie how/where the intention to claim is made public prior to the Judge deciding whether the JR can proceed. Is it listed on a website and what is made public, can the public see the claim form, can they see the statement of facts/grounds etc.

I am asking as I want to know how the media find out about JRs so that I can prepare for any media interest. I guess I am trying to gauge how much info is put out there so that I can understand what a claimant can discuss in the media without prejudicing the case or being in contempt of court.

I don't think they are published at all except some court judgments are published online. Journalists and others can I think go into courts in any case and ask to see those documents in some cases (not sure about JR) but it's a huge hassle. Anyone attending any hearing during the process will usually find the hearing is open to the public so they can learn what is being said about a case there which is one way the press hear about cases - they turn up at court.

All JR's are heard in public although the initial decision on permission is usually taken on the papers and does not become public.

Court Lists for the RCJ and the "provinces" for the Administrative Court are published daily but only for the following day.

An intention to bring a claim is not in the public domain and is dealt with in correspondence between the intended claimant and respondent.

But the issue of access to documents is interesting. It is easier go get hold of US documents published on line than traipsing down to a local court and trying to get hold of them. I expect this might change over the years.
