CSA and non-compliance

Does anyone know if there are penalties for non-compliance with directions from the judge at a hearing for information ie bank accounts etc?

This is a CSA tribunal? No penalties I'm aware of as such. You can ask them to draw inferences though. Write to them and draw the non-compliance to their attention. Ask them to warn the other party that inferences may be drawn.

Yes it is CSA. So essentially the person concerned can just not do anything to comply with the tribunal directions and the CSA do nothing too. I have already pointed out the first non-compliance to them in writing and this second one is also now nearly two months overdue. Does the Judge not make a decision about this? Does inference tend to err on the side of the person who is claiming?

You want to see the bank statements so that you can prove A. He says it's B, not A. His failure to produce the statements means that the tribunal is likely to conclude A.

Thanks for that. This is the second time he has not sent the required documentation. I alerted the CSA the first time in writing. Is it sensible for me to do it again or will they take it up now?

No harm in pointing it out again.

Thanks. Is it in our favour that he is not complying with directions essentially.
