mental health and divorce

Hi, just need a bit of advice?? Can someone be granted a divorce if they been suicidal and had mental health care in the last few months. He needs a carer present at any discussions or meetings who happens to be his girlfriend? Tia. X

Depends if he has legal capacity. Just because he has mental health issues does not mean to say he lacks capacity.

Is it him wanting a divorce or his ex? You can be divorced or get divorced with MH problems but possibly couldn't initiate proceedings if deemed incapable. Otherwise he needs to get legal advice
