Sole agency issues

Please help! We are selling a property. Sole agency agreement ends in 1 week with estate agent. We were planning on switching estate agents at the end of the agreement and dp met future agent yesterday to discuss arrangements for taking pictures etc. . Anyhow, agents somehow managed to get dp to sign new marketing agreement on the spot! Property is now advertised online and board outside! I haven't signed anything. Are we going to get stung by this? I am hoping thAt because I haven't signed new contract it is invalid...

I don't think you will get in trouble with your current sole agent. If you manage to secure a sale via them in the last week of your current agreement then everyone is happy. If you get a buyer through the new agent in the last week, could be a bit tricky in the cross-over period but I wouldn't worry about that unless you do get a buyer, then all I can see is perhaps a ding dong about which agent takes the commission.

What are the terms with your new agent? Are they a sole agent, do they know about terms with your current agent? Set a precedent with your new agent, take their advice but also be firm about how you want your property marketed. Did DP sign on your behalf? Try and negotiate their % fee down anyway.

Sole agent or not, it is your choice how property is marketed and when/whether it is put on line or have a board up. Personally we never had a board as that was too much in your face and for nosy neighbours/passers by, genuine buyers would look on the internet.
