Hi
Wondering if someone can help me with the land registry website.
In process of separating from husband & been advised to change tenancy.

Website says:

  1. fill in new or updated trust deed
  2. complete form sev to register a form A restriction

Second part is fine, but what's the trust deed? Is there a form for this? We are still both going to own the property just the basis is different.

Help please....

You don't need to do a trust deed if you'll still own the property 50:50.

If your husband agrees to the severance, you tick box A and both sign the form and post it to the Land Registry. They'll then amend the proprietorship register by putting in a restriction and send you a paper copy of the new register.

If your husband doesn't agree you need to tick a different box (don't have the form in front of me so not sure which one), and you also need to send him a Notice of Severance and send evidence that you've sent it to him. Ideally he should acknowledge receipt of the notice.
