We live in a private estate with legal right of access over 2 roads which take us to our house. One route has a weight limited bridge so is not passable by fire engines or oil tankers ( in country so we all have oil central heating)
A property developer has recently bought part of the estate and immediately dug up one of the roads (the one for fire engines etc) as they claimed not to know we had rights to it. After a week or so they patched it up but it's been left in a terrible state. Dhs car has grounded several times and been damaged, they agreed to cover cost of repairs.
However they refuse to sweep the road and it's been extremely muddy (inches deep) for weeks.
Now they have made us a temporary new road and closed off the old one again. Problem is its a mud track up and down a steep field. Dh car grounded on it again. Now that it has rained and tractors are also using it its impassable unless you have 4wd. I doubt a fire engine would get up, ditto oil tankers
My question is whether the develops have any legal right to re-route our road and replace it with one that's blatantly not fit for purpose.
There are about 10 home owners affected by this, not just us.
If it snows again we will be completely stuck as weight limited road has very steep hill with a huge drop and is not passable if it's icy.
Can anyone help with this?
