Redundancy during maternity

Hi don't know if anyone can offer any advice! I am on a permanent full time contract and have worked for my employers for five years. I am currently on a years maternity leave in which I only get stat maternity pay.nothing from employers.i am due back to work in June this year, however I was called into work at very short notice to be informed that they are making posts redundant.they have told me that the next month will be a consultation period and then from there it will be where they give us our notice period.however they have told me that given I am on maternity leave I will not be entitled to any pay for the notice period.is this right?

I was made redundant from maternity leave and I DID get pay for notice period.

You should consider consulting a lawyer. Many local solicitors will give you a free 1 hr consultation which should go a long way towards filling you in on your legal rights.

They can make you redundant while you are on maternity leave if there is a clear justification for doing so. However, if there are any other suitable roles within the business they must be offered to you even if other people being made redundant are more suitable for the roles concerned.

The statutory notice period is one week for each year of continuous employment completed up to a maximum of 12 weeks. They must pay that. If your contract gives you at least one week's more notice entitlement than the statutory notice period you have to rely on contractual notice where the law is unclear. If they are refusing to pay contractual notice you should consult a lawyer who specialises in employment law.

No advice to offer but I may be in a similar situation (restructure consultancy underway at present, due to complete end of March and baby due in August) so will watch this thread with interest as I'm absolutely terrified re: the implications should I be put 'at risk'...

I've coming to the end of my stat maternity pay on the 9th march this year. The consultation period they have to give ends on the 4th march and then the notice period starts.so even tho my maternity pay stops around this time should they still pay notice

Oh and they have stated I can apply for one post as well as the other members of my team.

I don't think they can make you apply for another role- you should be offered it if it's suitable. Get some proper advice OP.

Agree - if there's a suitable post then it should be ring fenced for you, and not be open to others.

Also agree. Even if other members of the team would be more suited to the role than you it must be offered to you first. They can only offer it to other people within the business if you turn it down.

Interesting reading! As far as I'm aware they have told us all that we can apply for this job.i haven't been offered this job first.
