Sick/Holiday Leave

If you are signed off sick for say, six weeks, and had booked a weeks holiday leave in the middle of that six weeks, what happens to the holiday leave? Sick leave is full pay.

CAB/ACAS seem to suggest you can ask that the holiday is cancelled and the whole thing goes down as sick leave. The employer in this situation has allowed 1.5 days that were booked as holiday in the six week period to be counted as sick but has said a second 5.5 holiday period will have to stay as holiday even though it was during the time that the employee was signed off as sick.

Can they do that?

Yes, I always understood that if you're sick, holiday is cancelled. I have even known people who were taken ill on holiday to take that as sick leave and have their holiday entitlement reinstated.

As long as it is appropriately certified, the holiday should be credited back to you if you were sick.

In my work we would change it all to sick leave, but don't think anyone has ever asked!
