HMRC recovering "debt" via tax code

Hi,

Hopefully someone can help me. I have been in dispute with HMRC for 3 years and am now at Tribunal stage. I have 2 overpayment for 2 award years.

Long and the short of it is that they have deducted on of the overpayments via my tax. The tax office confirmed 3 times that what they are recovering is a HMRC debt of £xxx which is same amount as one of my overpayments.

The tax credits dept have categorically denied this happening.

Can someone please tell me if it lawful to recover a debt which is yet to be proved and if possible provide a reference.
