litter clearing notice

I have just received a notice under section 92A(1) from my council regarding the fact that I had some bags of rubble from building work in my front Garden. They could have been there for a maximum of 2 days before being removed. We bought the property 3 weeks ago and have regularly visited the tip during our renovation work, although given I am 8 months pregnant and my partner works long hours there has probably been 4 sets of bags of rubble which in each case may have been there for 1-2 days before we could get it to the tip.

My dad was visiting on Saturday and saw a man from the council walking past with a clipboard making notes. By Sunday all rubbish was cleared. I received notice today dated Monday requiring me to clear it within 30 days.

I am aware that I have already complied but I'm so incensed that this was issued without the council officer actually knocking on my door and speaking to me. It just seems very unreasonable given that when the previous owner of the property called to request them come and dispose of his two old fridge freezers it took them 3 weeks to come and do it and they were chased numerous times.

Can I appeal the notice on the basis that on the date of the notice there was no litter in the area specified on the notice?
