I have my first hearing in court this morning. XP is taking me to court for access to my two DC.
I'm representing myself as is he. The cafcass report says he's a risk. Can anyone tell me what to expect today?

Can't tell you what to expect. But from the experience of others: stay calm, don't lower yourself to his standards by trading personal insults, keep it factual and focus on the needs of your dc.

If CAFCASS say he is a risk, focus on this. Good luck.

Could be worth posting in Relationships as well for higher traffic.

Hi, in my experience the court reviewed the information in the carcass reports and the proposals put across by both parties.

I don't know what reason Cafcass gives for your ex being a risk, whether that is towards you or the children. The ages if the children will also be a factor, if they are older their 'wishes and feelings' will also be taken into consideration before a decision is made.

Thank you. I'm very nervous, pregnant & tired. Dd is 6 and Ds is nearly 5 & has sen. He's at risk for being violent to lots of women including me. Very recently while being on probation also. The Dc have no idea who he is as they haven't seen him in 4 years, and only then a handful of times, all facilitated by me. He just stopped turning up. He has 4 other children he doesn't see and failed to mention to cafcass. I'm going to be strong, factual & fair.

How did it go?

stabbybitch · 30/04/2014 18:30

He didn't turn up. He was beaten up the night before and ended up in hospital with a broken jaw. He didn't let the court know, we didn't find out till the cafcass lady called to find out where he was. It's been rescheduled for 27th May (same day as my 20wk scan) as he has a trial for battery against his ex on the 15th may.

He sounds fabulous. What a pain in the ass that you're having to go through this.

All of which makes your case stronger.
