Hello

In 09 I gave a witness statement but they case was lost. 2 yrs ago the same law firm contacted me wanting me to sign to say my witness statement can be used in a civil case - defendant now suing for money. I refused but now fast forward to today and I received a witness summons forcing me to attend court.

How is this allowed?Do I have to attend?

Yes and yes I'm afraid. It does happen and all you can do is go answer the questions and that's it done.

It is allowed because a judge has considered it necessary in the interests of justice.
I work within the criminal justice system so not sure if it's the same for civil court but if a summons is issued for your attendance at criminal court and you fail to attend, the bench (mags) or judge (crown) can issue a warrant for your arrest. I would go if I were you
