Hi I'm hoping this is the righdc's ace to post this at my wits end with this and not sure how to go about things from here.
Quick back story I have 2dc's with my exh we were married our dc's are 9 and 10 9 yr old has sn. We split just before dc2 was morn in 2004 but he didn't leave the family home until March 2005. He has gone on to have another dc as have I . Contact has always been sparse last the children had contact was 2010 through phone calls after a 2 yr period of nc.
Maitaince has always been paid direct to a bank account every month. When it first started it was at rate set due to him being unemployed and has carried on at that rate.
2010 I received a letter after exh stopping contact due to being told dc2 was very probably sn. Letter stated my children did not live with me when they did. Case was looked into it was proved I was resident parent and at the time I was told they would look into payments to make sure they were correct and be in touch if they needed to. They didn't so took that as he was still unemployed.
Ff to August last year I received a letter stating they were looking into csa case as new information had come up . I contacted them to find out what this meant. I was informed they had received information exh was working and payments would change but it looked like there was arrears he needed to pay. I gave details they asked for and waited to hear back.
Since then there has been numerous calls and letters payments haven't been correct since 2010 they had worked out how much he had to pay and was working out how much he owed. Exh obviously wasn't happy said he couldn't pay due to credit cards cars and family responsibilities. I have been told he's questioning dc2 parentage and says he's not dc's dad, not a problem da test will sort this though dc2 being his d spitting image also backs me up.
I was told arrears couldn't be paid as someone who worked case in 2010 hadn't signed paperwork off properly, this mistake was admitted. Exh then began stating all his hours have changed so his wages are reduced so they had to work out payments again. He has blatantly stated if it's more then 100 a month he will not pay. Csa state they can't do anything as he may take them to court and he has a case.
I have now received a letter stating that he claims he's been paying the original amount since 2010 all the way through til this month which isn't case he stopped that in Oct last year. During a phone conversation csa worker told me they were informing him to do this.
I have rung them again a few times to find out what's going on and can't get anyone to tell me anything if I ask about payments they just tell me they are still working it out and today the system is down and I have to ring back.
My question is do I have just cause for complaint and how can I go about getting them to sort this out its been going on far too long I have tried to be fair about the whole situation and give the chances to sort this out. I'm really frustrated at the moment as I seem to get no where and it annoys me that the only responsibility he has taken he now seems to back out of. Throughout this whole last time with them they seem more concerned with him having a case to take them to court While I have to take care of dc's and provide everything for them.
