If I have a birth certificate without my sons dad on it can my fiance adopt him?

He has no contact with his father and he's not allowed any whatsoever (court ordered) the police are dealing with him at the moment due to harassment?

My husband adopted our son as his own - and I had to adopt him as well! Crazy when I gave birth to him - but this was about 20 years ago, so I wouldn't think there would be any problems. There was a social worker involved, she was lovely, have a look at this, and good luck! www.gov.uk/child-adoption

actually, that doesn't read very well - my son, but now our son? Does that make more sense?

CheckedPjs · 27/12/2013 15:44

Yeah it does Greyhound. I know they've changed it so only my partner has to adopt him and I don't (never got why that was in the first place!)

However he's court appointed PR just not BC, so we have copies of him not on the BC, would that be an issue?

There are a couple of good starter information leaflets online - this one is okay www3.hants.gov.uk/step_parent_adoption_booklet_27.11.07.pdf

You would start the process by contacting your local council as you and your partner need to be assessed by SS. You can go through the adoption process whether or not the biological father is on the birth certificate

Your husband can not adopt your son, but could apply to share PR. By making the application all people who currently hold PR would be notified.

Darknight - when did the rule change? Because that's what my husband did?

CheckedPjs · 28/12/2013 19:34

Why can he not adopt my son?

I guess because you'd need biological fathers permission as he has PR, which would be removed by adoption. Would he give permission? Am guessing by the way, not a lawyer.

DarkKnight123 is wrong. Your partner can apply to adopt your son provided your son has lived with both of you for at least 6 months. Some information about the process is available here.

I have rechecked my advice - am indeed wrong, apologies.
