speeding, failure to disclose driver

Hope someone can help - what is likely to happen in this scenario?

Notice of intended prosecution of speeding arrives in the post. Hands up, fair cop. But, driver could have been one of two people (registered owner and spouse). Can't remember which one would have been driving at that particular time. So plead guilty to speeding, but explain driver would have been either A or B (didn't want to pick one as photo evidence may have shown it was the other ifswim).

Police letter to court ignores explanation and says refuses to disclose driver.

Reply to court saying actually that's not what we said to the police, here's a copy of our letter to them where we said it was one or other of us, but not sure which. What is likely to happen in court?

Does the registered owner automatically get the fine/points (which is what we thought would happen) and does it sound like A could be found guilty of failing to disclose driver? Even if it currently looks like they're going to be penalised for telling the truth rather than lying? Surely that can't be right?

Genuinely wouldn't have a clue who drove when we left the house. We went to my sisters two days ago and I am just trying to remember who drove there. I genuinely can't. I know I didn't drive home as I had a drink and dh didn't so he drove - but I remember that as we had a discussion about it and so it was a deliberate decision as neither of us touch a drop if driving in next 11 hours.

How would we find who paid for the fuel? We share a cc and would have gone into the shop together and packed together - sometimes dh puts his card in yet I punch the pin in and get the receipt. Both carry wallets and house keys as standard so it could have been either.

I don't think anybody remembers routine things and for us driving is routine. Who loaded the dishwasher in your house a week ago? Who made the bed sunday morning?

We both carry keys to both cars with our house keys as swop cars on and off all week - I tend to take whichever is out on the road at the time I need to go out and sometimes we swop at work (one of us just goes and gets the other car for some reason and leaves theirs in its place - one of the cars is bigger so if we have to pick up animal food, hay, DIY bits etc then we would need the bigger one).

Dh and I are both same height and I may move the mirror but not consciously. Its a habit thing I think so not thought about. The only thing I do definately do differently to dh is that he puts the mirror on the anti reflection side in the dark, whereas I like to have the full glare of car lights behind so flip it to the other side. Apart from that I can't think of much we do differently.

We live rurally and drive all the time - in and out all day. I also drive for work using pool cars in and out all day - rarely adjust those either. Have had extra driving training too - in all I am, apparently, a pretty good driver so I have been told through assessment!!! Certainly haven't had, or been involved in, any accidents that were my fault! And certainly, without a doubt, good at paying attention when driving. But I really couldn't tell you who drove where a week ago - but I cannot see how that makes me a bad driver.

the registered owner of the car has agreed to know who is driving the car so that traffic law violations can be dealt with.

so they need to know who has driven the car and if they don't, they are in breach of their agreement to have a car registered in the UK.

so you need to take responsibly for knowing who is driving.

otherwise a car could be driven away from an accident - and if it took the police a couple of days/weeks to trace the car (few witnesses etc.) the driver could just say they did not know who was driving.

its pathetic to do a Chris Hume and Vicky Price and just decide who will get the points. Speed does actually kill people and general life changing injuries.
