Advice on spouse leaving marital home .

Advice please for my friend who's going through a separation.
They are married with young children and live in a house with a joint morgage. My friend's DH has been having an affair and as a result my friend no longer wants to be with him. She has asked him to leave but he refuses even though he has the option to go to his parents. How does she stand legally? thanks any advice would be great.

Because they are married they both have exactly the same rights to live in the former matrimonial home. One party moving out increases the living costs and very often families cannot afford to live in separate accommodation when they are separating without falling into serious debt.

The best thing your friend can do is to start divorce proceedings and
negotiate separating finances as soon as practical without inflaming the situation. When emotions take over it just hits the wallet, damages long term family relationships more than necessary and protracts the whole unhappy process.
