Water leak

My water supplier have found a crack in our water supply pipe under my neighbours garden. They are going to fix it but believe it has been leaking for about 10 years, we are not on a meter so had no way of knowing about this leak.
If this amout of water has caused any damage to the foundations of ours or neighbours house should the water company pay for repairs?
The water pipe cracked under our house about 20 years ago ( years before we owned the house) & caused subsidance.

Is there anyway of not having your water supply running under the neighbour's garden?

Is there a reason why they can't just lay in a new pipe from off the main, but on your property only.
