Sinking mattress 2 years later, advice please!

We purchased a Sealy bed from Bensons just over 2 years ago which was shy of £3K. It was actually the most expensive bed in the shop but was so comfy to lie on and with both my and DP having sore backs thought it would be worth the money. It is a normal spring bed however has a latex pillow-top. I remember when we bought it they said it would 'mould' to our bodies.

Fine. We used it for quite a few months and it was great. We rotated the mattress once a month which they said was important to ensure the mattress was kept at its best. However we started noticed big indentations where myself and DP slept which didn't pop back up when not sleeping on it. Also the bed is incredibly hot and seems to be getting hotter and hotter.

Now two years down the line the bed is terrible, the indentations where we sleep are pretty deep with a big hill in the middle inbetween us both. It's ridiculous Hmm and no we are Gain suffering from terrible back pain. Also the bed is incredibly hot. I know memory foam beds have a reputation of sleeping 'hot' but latex are meant to be better - and frankly this is just not. It's October and we still have both windows open and a summer 4.5 tog duvet and it is still sweltering!

My question to you is have I got any rights with regards to contacting Bensons or are they just going to fob me off because it's been 2 years? We are still paying for the bed as we purchased it on finance! Aren't beds meant to last 10 years? I don't think we can sleep on this bed for another week!

I actually googled the bed name and they don't sell it anymore, they sell a similar one. I have also seen numerous complaints online about the exact same bed, some people have managed to return them and some people haven't. If Bensons fob me off what can I do next? I'm just so annoyed about it all.

You would expect a quality mattress to last longer than 2 years. However, as it is older than 6 months it is up to you to prove that the problems are due to faulty design or manufacture and not misuse. If Bensons argue about that you may need to get a report from an independent expert.

You have the right to a repair or replacement, although the shop can choose which to give you. If they cannot repair or replace the mattress you are entitled reduced price or your money back less an amount for the use you have had.
