Child Maintenance through the Courts

Hi,
Can anyone advise how the courts deal with child maintenance? My husband earns in excess of the £3000pw maximum that the Child Maintenance Service takes into account. Do the courts use a similar formula to the CMS? Also as we would get the maximum amount available via the CSM, I'm advised this will never increase. If this is the case anyone know how we could deal with inflation in the future and equally annual salary increases? Thanks

Go to the CSA - simple as that.

No, not as simple as that. The CSA would still not take the full income into account.

The courts approach each case on its merits. They don't use a standard, one size fits all formula. They will look at the facts in the case and come to a decision. It will then be open to either you or your husband to apply for a variation if the situation changes.
