If you are making a claim under the Sale of Goods Act you have six years from the date of sale.

I am bring the claim under SGS Act 1982. But do I have 6 years to apply to the courts or to the date of the actual hearing? Basically, can I apply on the 9th Oct if the seller does not respond in time?

You have 6 years to start action but I wouldn't leave it to the last day. I would get started now.

I gave the sellers until 13th Sept to come up with a solution we can accept (we told them already what we think should be done). If we don't find common ground I will apply to courts on the 16th Sept.
