Moving Abroad

Hi
I'm hoping someone can help. My DH has been offered a job abroad which means the whole family (ds 13, dd 9 and dd 6) are potentially moving!
The issue is that dh is not ds' biological father. DS has had not contact with his bilogical dad since he was 3 months old, dh and I got together when ds was 6 months old and have been together ever since.
I'm not sure if I can legally take my son out of the UK without the sperm donor's permission, the minimum time we would go for would be 2 years.
DS does have a UK passport and i didn't have to have permission for that.
If anyone can advise I'd be very grateful.

It depends on whether your son's father has parental responsibility. As your son is 13 the only ways he could have got PR would be if he was married to you, or you entered into a PR agreement with him, or he got a court order giving him PR. If he does not have PR you do not need his consent to take your son out of the country.

Thx for the response, there has never been any parental responsibility so hopeful all will be good.

I gues it depends in what we need for the visa
