child benefit query

I have split from my husband and our youngest DS (age 14) lives with me.
I get approx £80 pm child benefit.
My exh says he should have half of this although DS never stays with him (he has a new partner) and never spends more than 3 hours a week with him.

Is this my money as DS lives with me?
We are now divorcing after a long marriage and Exh is not happy that I am entitled to half our assets so he is being very difficult.

CB goes to the resident parent AFAIK. he's got no claim.
Does he pay maintenance?

He does pay maintenance, he is a very high earner and really does not need half my CB!

It's all yours. You're entitled to CSA maintenance from him as well. The split in the capital may not be 50/50. You may be entitled to more than half. Make sure you get proper legal advice.
