Land Registry - fees and mortgage release

Just wondered if LR Rep or anyone else can help with these issues?

I have bought some land from a neighbour for consideration (less than £10k). The land I have bought is just part of their land, which is registered under one title and encumbered by a mortgage but the mortgage company agreed to release the land I was buying from the mortgage charge.

I have the TP1 form all completed. Do I need to wait for the mortgage release consent which is held by the seller's solicitor and send this with the TP1 to the LR?

I have looked at fees. Is this a case where a £40 fee is required? There are no charges on the land, a few restrictive covenants concerning use and maintenance of boundaries but that is all.

You can send your application in, with forms AP1, TP1 and any relevant ID forms, without the release but it will need to be submitted before your application can be completed so Land Registry will send you a reminder for that.

The £40 fee sounds right in your case as there is no fee for the discharge of the mortgage.
