If someone is on SMP for a day job can they legally work evening shifts a few hours a week?

Technically yes.

There is an argument that you can be unfit for work in one job, but not in the other - so manual labour is not possible but typing at a computer is.

However, I would be looking at any staff very closely if they did this.

If the authorities were to know would there consider it fraud? Is a few hours worth the investigation time.

maternity pay?

How does being on maternity make you unfit for work? I thought it was so you could spend time with your baby.

No idea about the law but my sister and some of her friends worked the odd shift for each other when they were on mat leave, so I assume it's fine.
