Some advice re neighbour please?

I hope this is in the right place. I live in a ground floor flat with my DH and we are expecting our first baby at the beginning of october. The guy in the flat above us has always been quite inconsiderate noise-wise, he seems to think he's a pro DJ and plays very loud very bassy music. Most of the time his "sessions" are during the day but can be very loud.

We have put up with the noise because it has mostly been in the daytime but newborns need to sleep in the daytime as well as at night obviously. I just wondered where we stand in this situation? Once the baby is here I will no longer be happy to put up with the noise as its not fair on a baby. He is a very angry unpredictable person who we have had problems with in the past so I could really do with some advice as to what to do in this situation.

It's amazing the noise babies can sleep through! If it is too loud give environmental health a ring so they can monitor the decibels.

Agree baby will probably sleep through it but if it annoys you (it would me), start making a log of occurrences and ringing the neighbour noise nuisance line at the council every time.

As a housing officer, I can tell you that if someone is making noise that can be heard outside the borders of their property - ie through the walls, floor etc, it is too loud an they can have action taken against them.

There is no time limit, it can be 1 in the afternoon or 1 in the morning. Phone your local council and report it. If it is disturbing you, they can do something about it. It doesn't matter if they are owners, private rented or in social housing. The law is the same.

I was more concerned that I would put baby down for a nap and then he would start up with the music and wake baby up as he seems to do this every time I go for a bloody nap!! Being pg and living under this guy has been stressful! The music is just the tip of the iceberg to be honest!! Thank you for your advice :)

B aware that you and baby are likely to be disturbing him very soon with crying and screaming from baby in the middle of the night. I would hang fire on making a huge fuss for daytime noise in case you then end up feeling. Uncomfortable when your dc is disturbing him.

I have to say I do feel that's a bit different, I will not be choosing to disturb him by deliberately being inconsiderate. He has a child that he has shared custody of who is very noisy anyway so I don't think that's going to be an issue. Doesn't a baby crying come under living noise or something like that? Sorry I feel it's completely different to playing very loud music.

Of course it's different. He is inconsiderate. Given though that he is according to your op very disagreeable he is unlikely to be easy to deal with. Personally I would avoid getting into an argument with an aggressive idiot who lives above me when I was just about to have a new baby. Not for his benefit but for your own sanity.

I think you should make a complaint and get it sorted ASAP. Apart from anything else, you'll want to sleep during the day when baby sleeps and you won't be able to if he's living it up upstairs m. Definitely worth getting it sorted before baby comes if you can. Hope it works out
