ex is in the Irish Republic and stopped paying maintenance in May 2012. Despite my best efforts, he won't pay towards ds's upkeep but it's all in an account for ds (according to granny)Hmm

The original CSA assessment was done 10 years ago when he was in the UK, he's got a far better paid job in Ireland shortly after the assessment was done but he's always refused to increase the amount (paying slightly below the CSA minimum). I've filed a REMO and am waiting for a hearing date, but I'm wondering whether the court will award the backdate (May 2012 to now) of the CSA assessed amount or whether they will ignore this and start from scratch, also is there a time limit for any backdated award? I can't find the answers online.

Fingers crossed he turns up!

I suspect that you'll have to write off the arrears. The CSA ceased to have jurisdiction when he went abroad (unless he was working for a UK company, or retained significant ties to the UK - it's a bit complicated to best to assume that the CSA lost its jurisdiction).

Don't know about Ireland, but in E&W the court will usually backdate to the date of the application.

I think it's a US company. I've done a little digging since starting the thread and it says 12 months with leave of the court?? (not sure what this means) It's not the end of the world, I just hope I get it sorted for ds. Thank you Smile
