need help securing home for children

My wife has walked out leaving me with the 5 boys she never put my name on the tenancy agreement and has left after not paying the rent for a few months hence the h/a has issued a notice seeking possession. I have told them i am willing to take on the debt but they say that i cannot as the debt is with in my wifes name. I have not told the h/a that she has left us yet. I need to know where we stand btw we have been in the house for around 10yrs.

You can apply within divorce for a transfer of tenancy, though I don't know whether you'd acquire the debt. Could the HA offer you an alternative property, free of the debt of the current tenancy?

You need to tell the HA that you are a lone parent.

I suggest that you make a formal application under the Matrimonial Causes Act 1973 (within the divorce proceedings) for a transfer of the tenancy. You also need to notify the Housing Association that the tenant is no longer in occupation but that given the length of time you have lived there, you wish them to consider a transfer.

Often a HA won't transfer without a court order, so you need to get on with both applications in tandem.

I have now told the H/A that she has left us and they are trying to contact her in regards to leaving the children quite funny that as i have been their primary carer for around 6 years. Lets face it i doubt her new man wants 5 kids around them.
They have not decided what they are going to do yet and im in contact with the cab so i gues we will see how it goes but i am apprehensive.
