Anyone know Employment Law. Please help, DH getting shafted

My DH was told today that he is getting put on a temporary redundancy for 4 weeks because there is no work. This means no money for 4 weeks and because it is temporary we are unable to claim on any redundancy policies. His employers have done this once before, they basically use the experienced staff as leverage to get more work/money contract wise by saying they are going to lay off the exp ones then bargain when the contractors kick off about losing the best staff from the job.

So today, 6 men who have been there for 15 years have been laid off for 4 weeks without pay when there are agency staff who don't know the job who have only been there a week who are still working.

This can't be right can it? Can anyone help re my DH rights, so worried about how we will manage right now

There is no such thing as temporary redundancy. Either you are redundant or you aren't. However, you can be laid off. Any lay off is on full pay unless your husband's contract says allows for unpaid lay offs. If he is on no pay he is entitled to guarantee pay of £23.50 per day for 5 days.

Sounds like he's being 'laid off' - an employer can require an employee to stay at home for up to 4 weeks if there isn't enough work for him to do. H needs to check his employment contract to see if there is provision for this.

agree with prh, no such thing as temporary redundancy and if he is sent home as no work unless it says specifically in his contract that it will be without pay then he has to be paid.
