Hi, can anyone advise me please. My husband and i split up in november 2011 and he has been living with sister since. He has used my address for mail and tax office wanting proof that he lives with sister. How can i send them proof if he had no mail delivered there.

When my xh and I split, I just applied for tax credits and they asked nothing about it. Based on this, I would have thought that the burden of proof was on the tax office, if you are saying he has moved out.

This is one for either a solicitor (if you can afford it) or CAB (if not).

With regard to joint finances, I provided a written statement saying he no longer lived here and returned any mail he hadn't had redirected and had no trouble.

HI thanks for reply. apparently they can just pull a name out of the hat to investigate. They are checking 2011/2012. They say they have no evidence of him being at another address and it is up to me to prove. Have to get his name taken off my address.

The burden of proof is on you to provide I'm afraid OP. There surely must be some proof that he doesn't live with you?

Where is he registered on the electoral roll? For council tax? Where do his bank, GP or employer think he lives? Does he have to fill in a tax return? Where do they send it if so?

Whose name is on the utility bills at your home? Same again re council tax and electoral roll. Who is listed and registered at your property? And more importantly wher is your ex registered if not at his sisters?

All these things will help you to provide the proof that he lives elsewhere. Unfortunately if any of the above turn out as him being registerd at your address you will find that they will insist that your claim as a single person is not valid.

Hi Bob, he did online banking so never got round to changing his address. Electoral role has never been updated.my name is on the utility bills for my home. see where your coming from though so will have to get him to get his name off this address and onto his sisters address where he is staying at mo.
