Applying for passport

Me and my ex husband were discussing applying for our daughters passport.

She lives with me but no residency order or anything like that, we both have PR and he sees her on agreed times although is involved in her life and sees her extra whenever he wants to.

Things got a little heated as i said i wasnt sure i wanted him to take our daughter abroad for as long as he wanted and he said he'd just apply for her passport himself.

i just wondered what the law is on applying for passports, could he apply and keep it? Even though she doesn't live with him.

It is my understanding that if both parents have pr then both can apply. Why don't you just apply first as only one can be issued
