Recoup money from an individual

Have also posted in Money Matters. Im in Scotland, how can I go about recovering money owed to me (£10k+) by an individual who is not standing by repayment agreement?

Was the loan made by way of an informal arrangement or was an agreement drawn up and signed by both/all parties stipulating the terms of repayment?

What evidence do you have - cheque/bank statement or similar - that you gave a certain sum of money to the individual?

Do you have any evidence that can be used to support your assertion that the sum was a loan made with the expectation that it would be repaid, rather than the sum having been made over to them as an outright gift?

Was the loan the subject of some family discussion or similar? Do you have any witness(es) to the chain of events that led to your generous gesture?

What was the total amount of the loan, was it made subject to interest, what were the repayment terms, and how much has been repaid to date?
