Who is my next of kin?

Living with partner & we have DD & I have DS from previous relationship.

I have a relationship with DF but not my mother so if anything was to happen to me before I have a will in place who would be my next of kin & inherit my estate?

your mother and father if your child was under 18, but don't quote me on that.
love the phrase 'if anything was to happen to me' - do you mean, if you die?

Yes Nellyjob that is what I meant but feels wrong seeing it in black & white.

I did think it was my parents so I need to sort my will ASAP I think.

If my DS was over 18 (16 now & DD 16 months now) would he be classed as my NOK and inherit everything assuming no will in place?

You seem to assume next of kin inherits the lot - not the case - if you die intestate there are loads of rules about what goes to whom... it would not all go to DS unless you write a will...

Next of kin and who inherits if you die intestate are two different things. If you an your dp own your house as joint tenants the house goes to him. If tenants in common or no owned property everything up to a certain amount goes equally to your dcs (in trust if under 18).

NOK is normally taken to mean who can give permission for medical treatment if you are unconscious, your dp should be able to do that although in reality the doctor would go ahead with what he/she thought was in your best interests medically.

But make a will!

your next of kin are your children.

if you didn't have children, it would be your parents.

it doesn't matter how old you are Hmm
(but if you're under 18, your parents would be asked permission for medical procedures, but that's a completely different thing)

ps: be careful, because if you died before your DP, your DS would get nothing because your DP is not related to him.
