I've made the decision to separate from my NSDH. He's been verbally and emotionally abusive for some years and I've had enough.
He's refusing to accept my decision with dignity. He won't leave the house (joint ownership and mortgage) so I think I'm going to have to leave with DS (age 4) and rent somewhere and then start legal proceedings.
I don't actually want to stay in the martial home as its too big and I don't want the association with him. However I also don't believe H can afford to stay in house & buy me out (he'd need to give me at least £40k).
So my question is:
If I rent somewhere with DS (leaving H in marital home) what will happen? What will legal procedure be? Will he be forced to agree to sell house if he can't buy me out?
