Have just joined so hope someone can answer my questions as our family are going through a bad time. 3 days after my father in law died my husband lost his job, but that is neither here or there! We live in Scotland so know the law is slightly different.. One executor of my father in laws will is happy for us to see a copy of the will as my husband and his sister are beneficiaries but the other executor, the step mother is not due to bad blood between the two families that has existed for years. She has never been happy for the two families to get along. She has been hospitalised for 9 weeks, including 5 weeks before the death. We were told the estate, including the house , would be divided equally between the 2 children and 2 stepchildren, 30 years ago. The will now goes into probate so will have to wait for the procedure to complete. We suspect my father in law owned the house, not jointly. Does the stepmother have the right to ignore his will as she outlived him and do as she wishes eg. Change her will to accommodate only her 2 children. It looks likely she will never return to the home. Do we as her step family have to sell the house and pay for her care? I know this is very complicated. Any advise would be greatly appreciated.
