following breach of court order (penal notice attached) - what is the maximum sentence the Judge COULD sentence to?

Probably depends on the type of order.

cantfindamnnickname · 01/06/2012 19:52

serious - but there must be a max sentence but I cant find it - any ideas?

Depends on type of order AND the culpability (really in the dark - v imprecise question asked).

OP, we need more details. If this is a contact order and the mum is contemplating ignoring it then the court could imprison her (unusual but not unheard of) for a few weeks as an example. They could also fine her or order her to do community service.

Non- contact order, could be different. You need to ask a fuller question tbh

I know of a case where a mum was committed for 3 months with another sentence suspended until after her release for failing to comply with a contact order. Presumably if after release she still wouldn't comply the mother would face a another 3 months sentence or longer.

Probably best to get some formal advice from a barrister. You can now go direct under the direct access scheme, for more see these links www.advisemebarrister.com/ www.advisemebarrister.com/direct-access-family-barrister - I hear stobart also offer fixed fee advice?
