Tradesman question

Hi,
I employed a tradesman to paint a fence. Specified the colour and finish (non-gloss)
He did the job in high gloss (!)
I paid 50% upfront.
What happens now-
I would hope that he comes back and re paints in a non gloss finish (as long as quality is not compromised)
If he refuses do I just refuse to make the final payment?

Is it gloss paint or is it an acryllic outdoor paint? I live in a shed wooden house and it's looks like it's gloss painted, but it isn't. It some special, last foreverish wood paint.
