Legal Aid for a Child - Clinical Negligence

Could anyone please advise on the position with regard to qualifying for Legal Aid. I may have a potential Clinical negligence claim on behalf of my DD. I understand that the claim would actually be made by her.

My question is whether children still automatically qualify for Legal Aid or whether the Parents' income and savings are taken into consideration? I have looked on the Government's website and information on Solicitors websites but the information conflicts. I believe there may be changes due in 2013 and would be grateful to receive any advice. Many thanks.

I made a claim back in 1992 on behalf of ds who was born with massive brain damage, and was successful, notwithstanding our income. We didn't go ahead with the claim, though.

TBH I don't do legal aid any more so things may have changed, but I think you are likely to get it at least up to the stage of getting medical records and a second opinion from a relevant professional, and then you'll need to make a further claim to take it to the next step.
