Distance sales? help/clarification please.

We brought 2 items of furniture in store, the actual items were not instore but the actual order was placed in store.

Items arrived - one was incorrectly described. The chair arrived with loose cushions instead of fixed. after much trouble the company eventually agreed and ordered a replacement over the phone. We had to pay an extra £100 for the new chair.

New chair has arrived, is of poor quality and is slightly damaged. Company has said we have to wait for them to decide to send out someone to look at the item.

As the item isn't of the quality we expected and the company is know for I asked if it would be covered through distance sales for return and refund. As this chair was ordered and partly paid for over the phone.

Company has said as the original order was placed in store, even though for a different chair, it isn't covered by distance sales. It this correct?

We have another issue with the other item of furniture and are completely fed up with this well know brand, customer service has been very poor and I'm loosing the ability to think clearly about the whole furniture situation.

Any help, advice or input would be very gratefully received.

I don't believe it would be covered by the distance selling regs, but it would still be covered by the sale of goods act (i'm not a legal bod)

AFAIK you should reject the goods ASAP, preferably in writing. Watchdog/sales of goods info here

Well, I ordered a bed in store from a well-known bed retailer. The actual bed was not actually there for me to see, so I was assured, because I had only seen it in a catalogue, that I was covered for a replacement if I didn't like it for any reason. Luckily I did like it, but I would say the same should apply in your case.
